Salzburg Adventures - General Terms and Conditions

purpose of the company

  1. Salzburg Adventures as a registered trademark of PEAK Adventures GmbH (SA for short) presents the range of adventures in Salzburg clearly and makes a pre-selection for its customers. The criteria are: safety, quality, service and of course fun. SA is the mediator of the leisure activities, but does not carry out the service independently. Organizers are various partners of SA (also called service partners) who carry out the service on their own account and are solely responsible for the implementation of the adventures/experiences. The terms and conditions of the service partners apply to the implementation.
  2. A contract between SA and the customer only comes about through the mediation service; the following general terms and conditions also apply in the version valid at the time of the order. The contract regarding the booking and implementation of the respective adventure is concluded directly between the customer and the respective organizer. The fulfillment of the booked service is therefore not the subject of SA's obligation to perform.

coupons

  1. The customer buys either a voucher for a specific type of adventure (adventure voucher) or a general voucher issued for a certain amount (value voucher). The vouchers must be activated online for a specific adventure/experience in order for the voucher to be redeemed with the partner. After activation, the customer and service partner receive each other's contact details and can set a date for the adventure. The voucher must be handed in to the organizer.
  2. Adventure vouchers can be exchanged for a value voucher. It is therefore possible to decide on another adventure before activation.
  3. If the value of the selected adventure is higher than the value of the voucher, the difference must be paid. Conversely, if the value of the selected adventure is lower than the value of the voucher, the remaining credit remains on the voucher. The remaining credit can be queried online using the voucher number.
  4. The voucher can be redeemed within 3 years of the date of issue. After this period, a one-time extension of the voucher for another year is possible for a processing fee of € 8.00 per voucher, plus the surcharge in the event of an increase in the price of the adventure.
  5. The voucher is freely transferable, but make sure that the person meets the requirements for participation in the adventure.
  6. Some adventures/experiences have a minimum number of participants below which the experience will not take place. In this case, the vouchers remain valid and a new date will be announced.
  7. The vouchers cannot be exchanged for cash.

ticket

  1. In contrast to a voucher, the organizer and the event date are already fixed when purchasing a ticket. The ticket no longer needs to be activated and the contact details of the organizer are already on the ticket. A right of withdrawal and exchange analogous to the adventure vouchers is excluded.
  2. If the adventure cannot be carried out due to force majeure, in particular bad weather conditions, the ticket can be redeemed like an adventure voucher on another day. However, if no new date can be found, the amount over the ticket value will be refunded at the customer's request. The decision as to whether bad weather conditions prevail that lead to the cancellation of the event is the sole responsibility of the organizer. Any travel or accommodation costs incurred will not be reimbursed.

Prices

  1. All prices are final prices and include statutory sales tax. In addition to the named prices, costs for packaging and shipping may arise, but these are shown separately.
  2. SA's price guarantee refers to the normal sales price of the service partner. Promotions or discounts for certain groups of people are excluded from the price guarantee.

Discount and benefit codes

  1. Discount or benefit codes cannot be combined with other discount campaigns. Only one discount code can be redeemed per order. A cash payment and subsequent offsetting against orders already placed are excluded.

payment arrangements

  1. The ordered vouchers can be paid by invoice (bank transfer), credit card or instant transfer. When paying by invoice, the amount must be paid within one week of receipt of the invoice. In this variant, the vouchers are only released for activation after SA has received the payment in full. When paying by credit card or instant transfer, the voucher can be activated immediately.

delivery

  1. The gift-wrapped voucher will be delivered within 3-7 working days to the address specified when ordering. The PDF version for last minute donors is of course available free of charge after a few minutes.

right of withdrawal
  1. Customers have the right to withdraw from this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which the customer or a third party named by him who is not the carrier took possession of the goods (or when ordering several goods that were delivered separately: the last goods) or . Has. In order to exercise the right of withdrawal, the customer must inform SA of the decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or e-mail). The attached model cancellation form can be used for this, but it is not mandatory. To meet the cancellation deadline, it is sufficient for the communication regarding the exercise of the right of cancellation to be sent to the following address before the cancellation period has expired: PEAK Adventures GmbH Halberstätten 21 5201 Seekirchen Email: buchhaltung@salzburgadventures.com Consequences of revocation: In the event of cancellation, SA shall owe the customer all payments that SA has received from the customer, including shipping costs (except for the additional costs resulting from the customer choosing a different type of delivery than the cheapest standard delivery offered by SA has chosen), immediately and at the latest within fourteen days from the day on which SA received notification of the cancellation of this contract. For this repayment, SA uses the same means of payment that was used in the original transaction, unless expressly agreed otherwise; under no circumstances will the customer be charged for this repayment. 
    Printed vouchers must be returned to PEAK Adventures' postal address; the customer bears the direct costs of returning the voucher. PDF vouchers naturally do not need to be returned.
    In the case of print vouchers, SA may refuse repayment until SA has received the print vouchers back or the customer has provided proof that the print vouchers have been returned, whichever is earlier. For all customers who activate their adventure voucher within the 14 days, the right of withdrawal expires prematurely, as this automatically means that the right of withdrawal ends prematurely. There is also no right of withdrawal when purchasing tickets.

Physical requirements of the participants

  1. Participation in certain experiences requires a minimum level of personal suitability (e.g. size, age, state of health, weight). These requirements are named in the individual adventure descriptions. Once activated, the purchaser of a voucher is responsible for ensuring that the relevant person who is to participate in the respective experience meets the minimum requirements. A refund of the purchase price is excluded in the event of non-fulfillment of the minimum requirements.

Right of withdrawal of the organizer (service partner)

  1. There is also a right of withdrawal if the experience cannot be carried out as a result of force majeure, in particular due to bad weather conditions. The decision as to whether bad weather conditions prevail that lead to the cancellation of the event is the sole responsibility of the organizer. Participants are obliged to consult the organizer in good time. In the event of cancellation by the organizer, the participant has the right to make a free rebooking. Any travel or accommodation costs incurred will not be reimbursed.

SA's right of withdrawal

  1. Until an experience is activated by the voucher holder, SA is entitled to withdraw from the contract for good cause. An important reason is, for example:
  • the organizer is no longer a service partner of SA or has generally ceased trading
  • it is not economically reasonable for the organizer to carry out the experience
  • Force majeure
If one of these cases occurs, SA will inform you immediately.


 In the event of withdrawal from the contract for an important reason, the customer will receive the booking price paid to SA back immediately. The customer also has the right to book an equivalent adventure from the SA offer. Further claims against SA, in particular claims for damages (e.g. travel expenses, accommodation), are excluded.

Changes to the offer

  1. SA reserves the right to make changes in the person of the organizer or the adventure. In the event of a significant change in the content of an adventure, the customer is entitled to withdraw from the contract free of charge or to choose an equivalent adventure from SA's offer.

Liability of Salzburg Adventures

  1. Information about brokered adventures/experiences is based exclusively on the information provided by the organizer and does not constitute a guarantee from SA to the customer.
  2. SA is not liable for the provision of the brokered adventures/experiences by the organiser, but only for the careful selection of the respective organiser, the proper mediation of the experience and the proper and verifiable transmission of information, advertisements, declarations of intent and payments between the customer and the organiser.
  3. SA is liable without limitation for damages resulting from the breach of contractual obligations up to the amount of the price of the mediated experience. SA is only liable for damage beyond this in the event of intent or gross negligence.
  4. SA assumes no liability for the unlawful redemption of vouchers. If vouchers or tickets are lost or stolen, the customer is therefore obliged to contact SA immediately so that the code can be blocked.

Retention of title / rescission in the event of non-payment / consequences of default in payment

  1. The voucher remains the property of SA until full payment has been made. Payment must be made no later than one week after invoicing (invoice date). After this payment period has expired, SA has the right to withdraw from the contract or cancel the voucher, resulting bookings or credit at any time. The statutory claims regarding the consequences of default in payment remain unaffected. The voucher is only redeemed under the condition that the purchase price for the voucher has been paid in full to SA.

Other Provisions

  1. The invalidity of individual provisions of the agency contract or the general terms and conditions does not result in the invalidity of the entire contract.
  2. The competent court in Salzburg is agreed as the place of jurisdiction for all legal disputes arising from a contract with business customers.
  3. All image and text material may only be used with the consent of SA.
